Your Use of TravelGay.com

TravelGay.com (“we”, “us”, “our”) is the trading name of Out4You Ltd whose registered office is at Sovereign House, Church Street, Brighton, BN1 1UJ, United Kingdom. We act as an agent for third party travel providers. We do not own or control those who actually provide the accommodation or other services which you book through us. All bookings made through TravelGay.com are Accommodation Only bookings and are Non-Package bookings.

 These terms and conditions may be amended from time to time and apply to all our services directly or indirectly (through distributors) made available online, through any computer or mobile device, by email or by telephone. By accessing, browsing and using our website or any of our applications through whatever platform and/or by making a booking, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including our privacy policy).

Website Accuracy

We take all steps practically possible to ensure that the details given to you on our website are accurate and up to date but we do rely upon the descriptions given to us by the actual suppliers of the services and facilities described. Sometimes the facilities or excursions described will be withdrawn for reasons such as maintenance or lack of demand from guests. There may be a charge for some facilities at a hotel. In some places during high season (and even at other times) there is a possibility you will be disturbed by noise from less considerate groups, so please bear this in mind when choosing your destination and accommodation. All accommodation providers reserve the right to collect a refundable breakages deposit on arrival, as well as city taxes and other fees in line with local legislation.

We cannot accept any liability for errors within our website descriptions which are as a result of the provision of incorrect information from your suppliers.

Accommodation Ratings

All ratings given on our site are based on our ratings, supplier ratings and are not necessarily the official ratings of the property. The ratings we use are based on certain criteria being met, which include but are not limited to the location of the hotel, facilities at the property and the range of dining options available.

Some properties on our website are classified as “TravelGay Approved”. Whilst TravelGay makes every endeavour to ensure a property meets our criteria, no warranty can be made for the acts or omissions of the accommodation or for the services provided.

Equality

We endeavour to work only with suppliers who meet our criteria for treating all customers equally. Where possible, we make clear to all suppliers the purpose of our business and that we do not tolerate any discrimination regardless of sexual orientation, age, disability, gender reassignment, marital status, race, religion or belief or sex and we expect all suppliers, sub-contractors and third party suppliers to adhere to this too.

Where possible, we ask all suppliers to adhere to the same stringent equality laws as set out in the UK Equality Act 2010 and any subsequent amendments regardless of their geographical location.

We endeavour to make every effort to provide information about a customer to the supplier at time of booking and ahead of arrival.

If you provide it, we will share details regarding your sexual orientation with our suppliers in order to ensure you receive the best possible experience from all our suppliers.

Whilst we endeavour to ensure that you are treated with courtesy, respect and equally in any booking you make with us, we cannot be held responsible for any actions of our suppliers.

Our website partners with Equaldex (www.equaldex.com) to provide up-to-date information on laws in individual countries. We are not responsible for verifying this data and it is provided as a guide only. The materials on Equaldex’s web site are provided “as is”. Equaldex and Us make no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Equaldex and Us do not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

When making a booking with us you are responsible for checking the relevant laws of a country and ensuring that you adhere to them. Whilst we can provide advice about the latest laws, it is your sole responsibility and your own decision as to whether you decide to travel to any particular destination.

Your Contract

We are a booking agent for the accommodation provider. When you make a booking, you enter into a contract with the accommodation provider via Us. Your contract is not with Us. As an agent we accept no responsibility for the acts or omissions of the accommodation or hotel or for the services provided. The accommodation provider’s terms & conditions will apply to your booking and we advise you to read these carefully as they do contain Important Information about your booking.

Currencies displayed on our website are for information purposes only and should not be relied upon as accurate and real time; actual rates may vary.

Obvious errors and mistakes (including misprints) are not binding.

Payment

Payment is safely processed before the cancellation deadline from your credit card, debit card or bank account to the bank account of the accommodation provider through a third-party payment processor. Your payment will be transferred to the accommodation supplier, minus any commission due to Us and, as such, you cannot reclaim such paid monies.

For non-refundable rates or special offers, you may be charged at the time you make a booking. For other rates, your card will be pre-authorised and then charged before the cancellation deadline. The cancellation deadline will be displayed when you make a booking.

Liability

Your contract for your booking is with the supplier or suppliers providing the actual product, facilities or services which you book and those suppliers are responsible for anything which goes wrong with your booking.

We act only as an agent in making your booking. We do not own or control the accommodation which you book or any of the other services, facilities or products which you book.

We shall not be held liable for any responses, information, contents, acts, omissions, or any breaches of any accommodation provider in relation to health and safety matters.

Accordingly, we have no liability or responsibility for anything which goes wrong with your booking unless caused by our own negligence. Since we act solely as an agent processing your booking the only circumstances in which we are likely to be negligent is in relation to the provision of dates or other information between you and the relevant supplier.

Complaints

Because the contract for your arrangements is between you and the hotel, any queries or concerns should be addressed to them. If you have a problem during your stay, this must be reported to the hotel immediately. If you fail to follow this procedure there will be less opportunity for the hotel to investigate and rectify your complaint. The amount of compensation you may be entitled to may therefore be reduced or extinguished as a result.

If you still wish to complain when you return home, you must make your representation, in writing, to the accommodation provider. We do not accept responsibility for dealing with complaints, nor do we have any liability for refunds or compensation.

Visa, Passport and Health Requirements

It is your own responsibility to ensure compliance with immigration, visa and health requirements.

Financial Protection and Insurance

Please note that there are no financial protection arrangements for bookings with TravelGay.com. It is your own responsibility to arrange suitable travel insurance for your booking.

Circumstances Beyond Our Control

Except where we say differently elsewhere in these conditions, we cannot pay any compensation, reimburse expenses, or cover losses for any amount or otherwise accept responsibility if, as a result of circumstances beyond our control, we have to change your booking after departure, or we, or our suppliers, cannot supply your booking, as we, or they, had agreed, or you suffer any loss or damage of any description. When we refer to circumstances beyond our control, we mean any event that we, or the supplier in question, could not foresee or avoid, even after taking all reasonable care. Such circumstances will usually include, but are not limited to, war, terrorist activity, pandemic, civil unrest, industrial dispute, bad weather (actual or threatened) and significant building work ongoing outside of your accommodation which is not known to us in advance of your departure date and building work from a third party (such as resort development).

Force Majeure, Unavoidable and Extraordinary Circumstances

Force Majeure means unusual and unforeseeable circumstances beyond the control of anyone involved with your travel arrangements. The consequences of these can often not be avoided even if all due care had been exercised by any travel arrangement provider. You may wish to purchase specific insurance to cover you for any out of pocket costs associated with a force majeure event. Examples of Force Majeure events include but are not limited to; an act of god, severe weather conditions, unforeseen traffic delays or strikes, war, threat of war or similar, terrorism.

Unavoidable and Extraordinary Circumstances means a situation beyond the control of the party who invokes such a situation and the consequences of which could not have been avoided even if all reasonable measures had been taken.

Unavoidable and Extraordinary Circumstances may cover for example warfare, other serious security problems such as terrorism, significant risks to human health such as the outbreak of a serious disease in either your home country or the travel destination, or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the destination.

Except where we say differently elsewhere in these conditions, we cannot pay any compensation, reimburse non-recoverable costs or expenses, or cover losses for any amount or otherwise accept responsibility if, as a result of Unavoidable and Extraordinary Circumstances, we have to change your booking after departure, or we, or our suppliers, cannot supply your booking, as we, or they, had agreed, or you suffer any loss or damage of any description.

We are unable to provide cash refunds in instances of Unavoidable and Extraordinary Circumstances when a supplier has not refunded us or there are non-recoverable costs associated with the booking.

In the event of Unavoidable and Extraordinary Circumstances when you are unable to travel to your destination, you will need to make a travel insurance claim.

Changes and Cancellation

If you want to change or cancel the arrangements you have booked in any way, you may do so from the Find Reservation section of our website. Changes are subject to availability at the time and to the accommodation providers’ terms and conditions.

If you have a late or delayed arrival on the check-in date or only arrive the next day, make sure to communicate this with the accommodation provider so they know when to expect you to avoid cancellation of your booking or the accommodation provider charging a no-show fee.

You are not permitted to change any names on any booking and at least one of the passengers (over 18) on the original booking must remain, unless you are prevented from travelling for reasons beyond your control and not simply from a change of mind.

If you do cancel, you must still pay any charges which arose before the cancellation, and any deposits paid for any pre-booked items or services.
By making a booking with an accommodation provider, you accept and agree to the relevant cancellation and no-show policy of that accommodation provider. Please note that certain rates, fees or special offers are not eligible for cancellation, refund or change. You may also be charged an applicable city/tourist tax when in destination and may still be charged this fee by the accommodation provider in the event of a no-show or charged cancellation. Please check the booking details of your product or service of choice thoroughly for any such conditions prior to making your reservation.

Late payment, wrong bank, debit or credit card details, invalid credit/debit cards or insufficient funds will result in your booking being cancelled automatically. Full payment must be received prior to the cancellation deadline. Once full payment has been made, a booking becomes non-refundable.

Currency Fluctuations

Should there be any increase in the cost to us, caused by currency exchange rate fluctuations, Government action, or changes in air or ferry fares, we will only absorb 2% change. You will be required to meet any increase above 2% and 10%.

Correspondence and Communication

By making a booking with Us, you agree to receive emails with details pertaining to your reservation. We may also follow up with requests for reviews and other promotional information. You may opt out of these communications at any time, but emails specifically relating to your booking will continue to be sent in order to ensure you are updated with any potential changes to your booking. In order to duly complete and secure your booking, you need to use a correct and valid email address that you have access to. We are not responsible or liable for and have no obligation to verify any incorrect or misspelled email address or inaccurate or wrong phone numbers or credit card numbers.

Privacy Policy

We are committed to protecting your privacy and security. All personal data that we collect from you will be processed according to our privacy policy.

Law and Jurisdiction

These booking conditions and any dispute or claim arising out of or in connection with them (including all non-contractual disputes or claims) shall be governed by and construed in accordance with English law and subject to the jurisdiction of the English Courts.
